General Terms and Conditions

Annotation
This text shall be governed by and construed in accordance with the laws of Germany. The English version of this text serves only for information and is not part of this legal transaction. Therefore, in the event of any inconsistency between the German and the English version, only the German version shall apply.

General
The business relationship between ART HOBBY and the customer subject to the following terms and conditions. Our offers are free, unless otherwise agreed. Different conditions of the customer need the explicit written consent of ART HOBBY.

Delivery time
The delivery periods stated by us are not binding, but are adhered to wherever possible. Acts of violence, such as strikes that affect our purchasing entitle us (but not the buyer) to withdraw from the contract or push out its fulfillment. Compensation claims of any kind are excluded in these cases.

Delivery of title
Failure to provide the service in case of non availability we reserve the right to explicitly.

Complaints
The purchaser agrees to make any defects or complaints immediately on receipt of the goods, but not later than 8 days and prior to processing or use of the goods to the Supplier against writing. Failure to comply with this obligation, the supplier is exempt from liability for defects. If an incorrect delivery can be proven, we make our choice for a credit note or replacement in flawless exemplary. Further Compensation claims are excluded. Liability is accepted for damage caused by improper handling, transportation and storm damage or other weather conditions.

Reservation of ownership
The delivered goods remain our property until full payment.

Shipping / Payment
Delivery is possible by advanced payment or Cash On Delivery (COD is only possible within Germany). For the calculation is always based on the date of delivery prices. Should be higher than at the conclusion that the customer is entitled within 14 days of notification of price increase from the contract. The conditions are deemed accepted, if not within one week of receipt of appeal is lodged. Pick up is possible only after prior agreement.

Warranty
The limitation period for defect claims is two years (one year if the customer is a business). For paid repairs and upgrades (hardware changes), the limitation period of 3 months. ART HOBBY can eliminate the defect at its option. To correct the defect, the customer has the ART HOBBY to grant a reasonable period of time and opportunity. The customer has particular responsibility to ensure that the object in question for examination and carry out the repairs to the ART HOBBY or his agent is available. If the client refuses or delays that this is unreasonable, he is the ART HOBBY exempt from liability for defects. If subsequent performance fails, the customer may rescind the contract or reduce the fee at its option.

Excluded from the warranty are damages and consequential damages, which are shown to be due by improper handling. We are not liable for damage not caused to the goods delivered; as we are not liable for lost profits or other financial damages of the buyer. An assignment of warranty claims to third parties.

Compensation
Extent permitted by law, our obligation is limited to the payment of compensation to the invoice value.

Law
For all legal relations of parties subject to the laws of Poland, excluding the draft law and the laws governing the international sale of goods. The invalidity of any of the above conditions the validity of the remaining clauses. Ineffective in this case the consensus is replaced by another, but the cost in its intention of the invalid clause comes closest.

Privacy Policy

Collection, processing and use of personal data
You may visit our site without entering any personal data. We will be storing only those access data which are not personalized, such as the page from which you have visited, or the name of the file requested by you. These data will be used exclusively for the purpose of improving our service to you. The data do not permit any inferences as to the person who has visited our site.

Personal data are collected only if you provide these data freely in connection with an order or by registering as a customer. The data which you have entered will be used without asking any further consent solely for the purpose of performing your order.

Send a contact request:
Personal data will be collected if you voluntarily notify us as part of the contact process. We use your data exclusively to provide you with the requested information, that is, only the information and data are stored and processed which are absolutely necessary to answer your request. Your data will then be deleted from our customer database, if you so wish.

Distribution of personal data
Your personal information will be passed on to the commissioned shipper only to the extent necessary. For the processing of payments we must pass on the relevant data to the authorized banking institution.

There will be no further circulation of your data beyond the stated extent.

Use of cookies
For the ordering process it is necessary to use session cookie. This is a small text file which is deleted from your computer after you have closed the browser. This file is used exclusively in order to run specific applications, such as the shopping cart application.

Data security
Your personal data are SSL-coded and transferred via the internet.

We have taken measures to secure our website, and all associated systems, against loss, destruction, access, modification or distribution of your data by any unauthorized persons. It is vital for access to your customer account that you enter your personal password. It is recommended that you do not disclose these login data to anyone and that you leave our shop pages by logging out properly, or by closing your browser window after completing your communication with us. This is especially important if you are sharing a computer terminal with others.

Right of access to personal data
In accordance with the German Federal Privacy Act you are entitled to information about the stored data free of charge. You are also entitled to demand that the stored data be corrected, blocked or deleted.

Instructions on withdrawal

Only consumers have the following right of of revocation:

Right of withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last good.

To exercise the right of withdrawal, you must inform us (ART HOBBY s. c., JASIŃSKI & W. DZIK, ul. Nowolipki 15, lok. 12, 00-151 Warszawa, POLAND) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post, fax or e-mail). You may use the attached model withdrawal form, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. You will have to bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
